By accessing and using this website, you agree to comply with and be bound by these Terms in full. If you disagree with any part of these Terms, you must not use our website. These Terms apply to all visitors, users, and others who access or use the Website. Please read these terms carefully. Your use of the Website and the services, and your purchase of any Products on this website, will be governed by these Terms.

    For the purposes of these Terms:

    – “We”, “Us”, “Our” refers to Beaunex, the owner and operator of this website.

    – “You”, “Your” refers to the user or viewer of our website.

    – “Products” refers to all items available for sale on our website, including but not limited to nail builders and related products for nail services.

    • Use of the Website

    You agree to use our Website for lawful purposes only and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the website. Prohibited behavior includes, but is not limited to, harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our website.

    • Account Creation and Maintenance

    To access certain features of our website, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

    • Orders and Payment

    All orders placed through our website are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or any other issue identified by our order processing department.

    Payment for products must be made at the time of ordering via our accepted payment methods: Card Payments via Stripe, Bank Transfers, Google Pay, and Apple Pay. By providing payment information, you represent and warrant that the information is accurate and that you are authorized to use the payment method provided.

    We reserve the right to modify the prices of our products at any time without prior notice. All changes will be effective immediately upon posting on the website. The prices applicable to your order will be the prices that are in effect at the time you complete your order.

    • Shipping and Delivery

    We ship to customers in Cyprus, Israel, and various countries within Europe, which are listed on this website under the page Beaunex. Shipping costs will be calculated and communicated to the client before the completion of payment. We endeavor to dispatch all orders promptly; however, we are not responsible for delays caused by customs or other factors beyond our control. Title and risk of loss for all products ordered by you will pass to you upon our delivery to the shipping carrier.

    • Order Cancellation Policy
    • Under Cypriot law, you have the right to cancel your order within 14 days without giving any reason. This 14-day cancellation period will start from the day the product is collected from the delivery destination, as defined on the website, which is considered the day you take physical possession of the goods.  If you   choose to cancel the order within this period, you will be entitled to a full refund, including the costs of standard delivery (if applicable). However, you will be responsible for the cost of returning the products to us. If you return the products because they are faulty or not as described, you will receive a refund for the standard delivery cost only, after your claims have been reviewed and approved by us. To exercise the right of cancellation, you must inform us of your decision to cancel the order  by a clear statement (e.g., a letter sent by post, fax, or email). You may use the model cancellation form provided in our Terms , but it is not obligatory.

      Once we receive your notice of cancellation, we will reimburse you without undue delay and not later than 14 days from the day on which we are informed about your decision to cancel the order. We will use the same means of payment that you used for the initial transaction unless you have expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

      The right to cancel an agreement does not apply to certain products, as detailed below, under clause 8 ” returns and exchanges”. 

    • Returns and Exchanges

    Products that have been opened or used, custom-made or personalized items and products that are inseparably mixed with other items after delivery, are not eligible for return or exchange unless they are faulty or not as described.

    Specific product descriptions will indicate if warranties or guarantees are provided and any conditions for returns or exchanges.

    Due to sanitary reasons, the following products cannot be returned or exchanged under any circumstances:

    – Chemical Products: Base coat (Natural base, rubber base, classic base, cover base, flexible base), Top Coat (Miracle top, Rubber top, No sticky top, Matte top, Glossy top, Matt black dots top), Gel color, Builder Gel, Easy Duo Gel Soft (Acrylic gel), 

    Primers, non-acid primers, acetone, cuticle removers, cuticle oils, Nail freshener,  Cleanser, Monomers, Nail glue, Ll Mago moisturizer spray.

    – Electrical Products: Nail Driller, Ultrasonic, Sterilizer with quartz beads, Dry heat sterilizer.

    – Metal Tools: Nippers, Scissors, Pushers and scrapers, Storage box.
    – Non-Metal Tools: Wooden sticks, Plastic sticks, Buffers, Files.
    – Disposable and Miscellaneous: Plastic tips for nail extensions, Menicure Ped (different sizes), Cleaning pads, Sterillizer bags.

    If a product is faulty or not as described, please contact our customer service team at +972-545813110 for assistance. We will provide instructions on how to return the faulty product and issue a refund or exchange as appropriate.

    • Product Information and Disclaimer

    The information available on or through this website, as well as the services provided through or in connection with this website, are for information only and do not constitute recommendations, instructions to action or medical advice. Unless otherwise specified, the products are for cosmetic purposes only and have not been approved by any medical or pharmaceutical licensing authority.

    The Website or documents sent with the Product, or the packaging or labeling of the Product may contain instructions for use, warnings, contraindications and other notes. You must carefully read and follow these notices and ensure that other entities using the Products do so. We are not liable to you if any of these requirements are not met. It should be noted that Beaunex is not liable for the accuracy or completeness of the notes that were not exclusively prepared by Beaunex.

    • Limitation of Liability

    To the fullest extent permitted by Cyprus law, any damages that you might incur, the entire liability of Beaunex under any provision of this Terms and your exclusive remedy for all the foregoing shall be limited to the amount actually paid by you for Beaunex.

    To the fullest extent permitted by Cyprus law, Beaunex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the website; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our website; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our website by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the website; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

    Beaunex does not seek to exclude or limit liability for:
    (a) death or personal injury caused by our negligence or the negligence of our directors, employees, agents or subcontractors;
    (b) fraud or willful misleading;
    (c) violation of any obligation and / or liability imposed on Beaunex by any national legislation or regulation of Cyprus and / or any Directive or regulation of the EU.

    • Force Majeure

    Beaunex shall not be liable for any failure to perform its obligations under these Terms if such failure is caused by an event beyond its reasonable control, including but not limited to acts of God, terrorism, acts of civil or military authorities, fire, floods, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials. In the event of any such delay, Beaunex may be excused from such performance to the extent it is delayed or prevented by such event, and the time for performance shall be extended for a period equal to the duration of the delay.

    • Indemnification

    You agree to defend, indemnify, and hold harmless Beaunex, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the website; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the website.
